Filtrix Licensing Policies

Following is a license contract that describes our license terms. You, the end user, are referred to below as the "licensee." The software program, Filtrix, and its descriptive documentation are referred to as the "licensed product" or as "product" below.

Grant of License

Blueberry Software grants this limited license to licensee to use the product for personal or commercial purposes and to make a single archive or backup copy of the program. The product is licensed only on the terms and conditions specified in this document, and the licensee gives evidence of his acceptance of these terms and conditions by any use of the product.

Term of License

The license is effective on the date the licensee receives the licensed product. It continues in effect until the date the licensee ceases any and all use of the licensed product and either destroys or returns all copies to Blueberry Software. Violation by licensee of the terms of this contract shall terminate the license to use the product.

Our Agreement

Blueberry Software intends, and licensee agrees, that unless explicitly and formally permitted in a written document issued by Blueberry Software, the licensing of a single and each individual copy of the product is restricted to its use by a single user on a single computer at any one time. This restriction remains regardless of the technical capabilities of the computer onto which the licensed product is installed to share a single program among more than one user. As an example, if licensee purchases a single license and installs the Blueberry Software product on a computer network, and if then more than one user simultaneously uses the product, the license has been violated. If the licensee desires simultaneous use of the program by more than one user, either employing many computers or a single computer, he or she must contact Blueberry Software to purchase additional licenses.

Except as expressly permitted by Blueberry Software in this document, the licensee may not use, copy, publish, dissassemble, or decompile the product licensed, nor may the licensee sublicense, sell, lease, or transfer the product in any way to any other party.

The licensee will take all reasonable steps to protect the licensed product from use contrary to this agreement. The product is the property of Blueberry Software; it is protected by the laws of copyright and by contract. This license contract may only be modified by a written document signed by both Blueberry Software and the licensee. It may not be modified by a purchase order or by advertisement. Both published and unpublished rights are reserved under the copyright laws of the United States, and this contract shall be governed by the copyright laws of the United States.

This license grant does not allow the licensee to use Filtrix to produce conversions as an Internet service. Blueberry Software reserves the right to determine the applicability of this aspect of its license, and at its option, to refund a customer's purchase price and withdraw the grant of its license. Users interested in offering this use of Filtrix are invited to contact Blueberry Software regarding special licensing terms.

Limited Warranty

Blueberry Software warrants the licensed product to be free from defects in media and documentation for a period of 90 days from receipt by the licensee. In addition, the software program itself is warranted to perform substantially in accordance with the user's manual (or online Help manual in the case of Filtrix for Windows).

Blueberry Software will in no event be liable to licensee for any incidental or consequential damages or for lost profits.
